Terms of Service
Effective date: August 13, 2026
1. Agreement to these Terms
These Terms of Service ("Terms") are a legally binding agreement between you and Suzhou Maifangbao Technology Co., Ltd. ("we," "us," or "our"), a company registered in the People's Republic of China that operates the vischart service at https://vischart.com (collectively with the vischart web application and related services, the "Service").
By creating an account, accessing the Service, or purchasing credits or other paid features, you agree to these Terms and to our Privacy Policy at https://vischart.com/privacy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
2. Eligibility
You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms.
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase credits, subscriptions, or other paid features.
You may not use the Service if you are barred from doing so under applicable law, including export-control or sanctions rules.
3. The Service
vischart is a browser-based data visualization canvas. You can create charts, maps, posters, presentations, and similar visual work, store projects in a workspace, export files, share links, and optionally use paid AI features.
The canvas workspace is provided without a subscription fee. AI generation, editing, and related automated features consume credits or other paid entitlements described in the product and at checkout.
We may change, suspend, or discontinue any part of the Service, including features, models, credit prices, and availability. We will try to give reasonable notice of material changes that affect paid features.
4. Accounts
You may sign in with a supported identity provider (currently Google or Apple). You are responsible for the security of that account and for all activity under your vischart workspace.
You must provide accurate information and keep it current. Notify us at support@vischart.com if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms, that appear fraudulent or abusive, or that we are required to restrict by law.
To close your account, email support@vischart.com. We will delete or de-identify personal data associated with the account as described in the Privacy Policy, except where we must retain records (for example, billing, security, or legal compliance).
5. Fees, credits, payments, and refunds
Certain features, including AI generation, AI image tools, chart assistance, and related utilities, require credits. Credit prices and per-action costs are shown in the Service. Promotional or welcome credits have no cash value, are not transferable, and expire if we state an expiration, if your account is closed, or if we discontinue the credit program.
Purchased credits are prepaid digital goods delivered to your account when payment succeeds. They may be used only for the Service. Credits are not legal tender, cannot be exchanged for cash, and are not transferable except as required by law.
Payments are processed by a third-party payment provider (such as Stripe). We do not store full payment-card numbers. The price, currency, taxes, and any recurring interval shown at checkout are the amounts you authorize. You are responsible for applicable taxes unless we are required to collect them.
Refund policy. Except where required by applicable law:
- Promotional and welcome credits are non-refundable.
- Purchased credits are non-refundable once they have been added to your account.
- If an AI request fails to complete because of an error on our side or a provider outage, we restore the credits charged for that request.
- Credits consumed by a completed request (including results you consider unsatisfactory, inaccurate, or not to your taste) are not refunded.
- We may, at our discretion, issue a refund or credit adjustment for duplicate charges, unauthorized payments, or similar billing errors if you contact us promptly at support@vischart.com.
If you are a consumer in the European Economic Area, United Kingdom, or another jurisdiction that grants a statutory cooling-off period for digital content, you agree that we may begin supplying purchased credits immediately after payment, and you acknowledge that you lose any withdrawal right once the credits are delivered to your account, to the extent permitted by law. Unused purchased credits may still be refundable where a statute requires it; email support@vischart.com to request a review.
Subscriptions. If you buy a subscription, it renews automatically at the then-current price until you cancel. Cancel in the account billing controls or by emailing support@vischart.com before the renewal date. Cancellation stops future charges; it does not refund the current billing period unless required by law or we state otherwise at checkout.
Chargebacks and payment disputes. Please contact support@vischart.com before opening a dispute with your bank or payment provider so we can try to resolve the issue. Unjustified chargebacks may result in account suspension.
6. Acceptable use
You agree not to, and not to allow others to:
- Violate any law, or infringe intellectual-property, privacy, or publicity rights.
- Upload, generate, or share child sexual abuse material, or content that exploits or endangers minors.
- Upload or generate malware, or attempt to probe, scan, or attack the Service.
- Interfere with or disrupt the Service, including by excessive automated requests, scraping that burdens our systems, or circumventing rate limits, credits, or security controls.
- Misrepresent your identity or affiliation, or use the Service to send spam or phishing.
- Use AI features to create deceptive content intended to defraud, or to violate another provider’s rules that apply to models we call on your behalf.
- Resell, sublicense, or provide the Service to third parties as a competing platform except with our written consent.
We may remove content, revoke share links, disable plaza listings, or suspend accounts that we reasonably believe violate this section.
7. Your content
You retain ownership of the projects, datasets, text, images, and other materials you submit to the Service ("User Content"). These Terms do not transfer ownership of User Content to us.
You grant vischart a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for example, to transcode, generate previews, or render on the canvas), and display User Content solely to operate, secure, and provide the Service, including sharing a project when you create a public share link or publish to the plaza.
Share links are accessible to anyone who has the URL until you disable sharing. Plaza listings may be visible to other signed-in users. You are responsible for not sharing confidential material.
You represent that you have all rights needed to submit User Content and to grant the license above, and that User Content does not violate these Terms or applicable law.
8. AI features
AI features send prompts, uploaded files, reference images, and related context to third-party model and infrastructure providers in order to generate or edit output. Those providers process the data under their own terms and privacy policies.
As between you and vischart, you may use AI output for your own purposes, including commercially, subject to these Terms and to any third-party model terms that apply. We do not claim ownership of AI output generated for you.
AI output may be inaccurate, incomplete, biased, or similar to content produced for others. It may not be unique and may implicate third-party rights. You are solely responsible for reviewing output before you rely on it, publish it, or use it in a professional, medical, legal, financial, or other high-stakes context. The Service does not provide professional advice.
vischart does not warrant that AI output is non-infringing or fit for a particular purpose. You agree not to use AI features to generate prohibited content described in Section 6.
9. Intellectual property; DMCA
The Service—including software, design, templates we provide, and the vischart name and marks—is owned by vischart and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own projects in accordance with these Terms.
Stock photos, fonts, icons, and similar library assets remain subject to their original licenses (for example, Unsplash, Google Fonts, and icon libraries). You must comply with those licenses when you export or publish work that includes them.
If you believe content on the Service infringes your copyright, send a notice to support@vischart.com with: (1) your contact information; (2) a description of the copyrighted work; (3) the location of the allegedly infringing material (URL or project identifier); (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act; and (6) your physical or electronic signature. We may remove content and, where appropriate, terminate repeat infringers.
10. Third-party services
The Service depends on third parties, including hosting and authentication providers, object storage, payment processors, font and image CDNs, geocoding, and AI model providers. Their terms govern your use of their services. We are not responsible for third-party outages, policy changes, or content.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISCHART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AI OUTPUT OR EXPORTS WILL MEET YOUR REQUIREMENTS.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISCHART AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO VISCHART FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100). THE FOREGOING DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING CERTAIN LIABILITY FOR FRAUD OR PERSONAL INJURY.
13. Indemnity
You will indemnify and hold vischart harmless from claims, damages, and reasonable legal fees arising out of your User Content, your use of AI output, your violation of these Terms, or your violation of any law or third-party right.
14. Changes, suspension, and termination
We may update these Terms from time to time. The revised Terms will be posted at https://vischart.com/terms with an updated effective date. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and request account closure.
You may stop using the Service at any time. We may suspend or terminate access immediately if you breach these Terms, if we reasonably believe it is necessary to protect the Service or others, or if we discontinue the Service. Unused promotional credits are forfeited on termination. Unused purchased credits are handled according to the refund policy and applicable law.
15. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, excluding conflict-of-law rules. Mandatory consumer-protection laws of your country of residence still apply where they cannot be waived.
Before filing a claim, you agree to contact support@vischart.com and try to resolve the dispute informally for at least 30 days. If we cannot resolve it, either party may pursue relief in a court of competent jurisdiction in Suzhou, Jiangsu, People's Republic of China, except where applicable law requires another forum. You and we waive class actions to the extent permitted by law.
16. Miscellaneous
These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject. If a provision is unenforceable, the remainder stays in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Failure to enforce a provision is not a waiver. Sections that by their nature should survive termination will survive.
